I can't wait to actually head down there and roll video that will be a hoot, huh..... So my little Courthouse Birdy told me a Decision came down a couple weeks ago in this case. As you can see, Lee Levine Bowser (the lawyers for this sperm donor criminal maggot who never spent any time with his daughter) spent plenty of time lingering in my journals yet they lacked the cajones to actually do First Amendment battle with me face to face.

Anyway I can't get much out of my source this time because he knows they really don't want this Decision ever coming public. All I know is that the court ignored his history of lies and deceit in this case on his residency when he was initially served by the mother, and they actually reduced payments and put on some kind of GPA requirement for his daughter or else she looses all the money..... all of this is unverified right now because that's the way these dirtbags want it, and the Court is more than happy to oblige, no doubt maligning me all the way. So now the mother has been fucked all around: Her lawyer fucked her (literally while she was still a client) but that's not an ethical violation in Mass, go figure.... then the high-powered lawyers at Lee Levine tag teamed her and her daughter to finish this little chapter of smut.

Then there is a certain high-powered black journalist (A Medill Grad like Cousin Mike) who is racking up the big bucks while purporting to provide alternative and insightful news to the public... and he told me he didn't want to hear about any of this case. He can kiss my ass too. All of these people can malign me all they want but the shame, however is not mine. That much is verified and I'll set it out right here, just like that.

It's pretty complicated and involves a postal inspector, a paralegal and some dangerous liasons, but suffice it to say there are again ethical questions about Jeffrey Denner's hired help. As Boston Bob I busted on Denner's office when they got judges to issue patently Unconstitutional rulings against Derrick Gillenwater (shut down all of his Free Speech rights) after they committed ineffective assistance of counsel in his case. And I have some very serious concerns in the matter of his office's representation of Daralyn Khan in her child support enforcement case against International Felon, eMusic CEO and Columbia J-School professor Adam Klein. Specifically it starts with one Linda Ouellette but is in no ways limited to her. More on this when I feel like it. 6:30p update: Robert O'Connell Attempted Murder/Assault trial scheduled for 15 May 2007 courthouse steps video coming by 9p at the latest.

Note to the Herald: Quit removing my comments they are fully protected by the First Amendment, and what do you know about protecting yourself from Defamation anyway, not much. Okay I was just getting ready to head down to the Courthouse to check up on the status of the Robert O'Connell, Joseph Fasano, Jennifer Bynarowicz Quincy Cocaine road rage shooting in which Fasano -- with a known domestic violence past -- was reported to have cocaine on his face. There was cocaine in the Bynarowicz Jeep and she copped to it as seen by the KingCast court file investigation.

"Who did you get the cocaine from?"

"You [won't] believe me," says O'Connell.

Interesting. You might want to check and see who carried the insurance on her Jeep, I dunno it might be relevant, it might not. Just sayin'.

But now we apparently have much more than that going on folks, as the Boston.com screen capture shows... William S. O’Connell, who is O'Connell's uncle ~~or father~~ and former State Senator, was popped for 19 golden grams and Stat Rape with a kitlin' 14-16 years of age..... Whoa. See folks have been telling me that years ago one of the elder O'Connells' friends turned up dead off a yacht during a little cocaine party and I have told these people that I will always report what is reasonably true. At this point I cannot -- nor can anyone -- actually substantiate the yacht party cocaine but I now feel comfortable enough to mention the rumour on my page.

Note that the Patriot Ledger's excellent coverage mentions the incident and the dismissed drunken operation charges as well as his son's second-degree murder in the stabbing death of 22-year-old Julie Hamilton, who knew Matthew through her boyfriend. Matthew O’Connell is being held at Bridgewater State Hospital, a medium-security facility for inmates deemed in need of psychiatric care.

As noted in the Passover Seder journal entry, Multimillionaire International felon, eMusic CEO and Columbia University adjunct professor Daddy Adam Klein pulled a disappearing act, stop and read the legal pleading excerpts by Boston Attorney Jeffrey Denner. More on this later today, I am still researching whether or not Judge Dilday erroneously allowed him to evade service back in 2004 when he clearly had a valid Massachusetts Driver's License. Not only that, he did not register as a New York voter until 30 June 2004, or two weeks after he was served by Ms. Khan, and he did not apply for a New York Driver's License until 24 April 2007, ahem. Why is the Court apparently protecting this moneyed and privileged fellow instead of making him accountable like the ordinary blokes who have to pay child support?

Anyway the entire point here is that it's not about the color of your skin or your religion, race or ancestry.... it is about the content of your character, as my namesake so aptly noted many years ago......

I told you back on 4 Jan. 2011 that Judge Dilday refused to allow Daralyn Khan to get the RMV records on this felon that would have proved he was lawfully served in Massachuesetts. Well I have some of those records and plan on getting more. As a teaser I will now share the Massachusetts RMV records (with SSN/DL number redacted of course) that tend to show that Adam Klein held a Massachusetts Drivers' License in August, 2004. And this guy's conditions to avoid imprisonment were no further acts of deception, fraud, perjury, etc..... Why are the Massachusetts courts protecting this guy and putting the wood to the mother and daughter, it is simply foul. Is there a payout involved because that is the only way this shit makes any sense.

As to Ms. Klein and her daughter, who sit by waiting while Klein banks millions, give 'em hell ladies, bring out a Bobby Knight can of whup ass!

And I also know that Adam Klein has made quite a few enemies over the past several years as the jet-setting CEO -- some folks hate him so much they friggin' posted his severance packages online. That's Judge Kagan on vacation somewhere. More beach pictures in the video. What's fascinating is the lack of background in the major press story seen here at the Boston Herald, so I provided a little background relative thereto, including how Hizzoner was reversed on appeal after he re-wrote the Korff pre-nup from the bench. He had to recuse in a couple of cases because of his relationship with Lee, Levine & Bowser who helped him on his ascension to the bench while he fought off a pending malpractice case.

As promised, I paid a visit to the Boston ACLU office today regarding some concerns I have about potential gag orders and Unconstitutional Prior Restraint against the press relative to Adam Klein's criminal history and extended attempts to short-change his daughter on child support. May I remind you all right now that gag orders in civil cases are presumptively invalid, and there must be a compelling governmental interest, with a plan narrowly-tailored to meet such interest that is not overbroad. Anyone and everyone has standing to pursue an overbroad statute. See also Capital Cities Media, Inc. v. Toole 463 U.S. 1303, 103 S.Ct. 3524 U.S.,1983. “It is clear that even a short-lived “gag” order in a case of widespread concern to the community constitutes a substantial prior restraint and causes irreparable injury to First Amendment interests as long as it remains in effect.” As for the State's concern for the jurors' privacy, we have not permitted restrictions on the publication of information that would have been available to any member of the public who attended an open proceeding in a criminal trial, Oklahoma Publishing Co. v. District Court, 430 U. S. 308,430 U. S. 311-312 (1977) (per curiam); Nebraska Press Assn. v. Stuart, 427 U. S. 539,427 U. S. 568 (1976), even for the obviously sympathetic purpose of protecting the privacy of rape victims, Globe Newspaper, supra, at 457 U. S. 607-609; Cox Broadcasting Corp. v. Cohn, 420 U. S. 469, 420 U. S. 491-495 (1975). See also Smith v. Daily Mail Publishing Co., supra, at 443 U. S. 104:

"If the information is lawfully obtained . . . the state may not punish its publication except when necessary to further an interest more substantial than is present here -- i.e., protecting the privacy of an 11-year-old boy charged with a juvenile offense. In an extraordinary case, such a restriction might be justified, but the justifications must be adduced on a case-by-case basis, with all interested parties given the opportunity to participate, and less restrictive alternatives must be adopted if feasible. And if the Court is going to issue any sort of gag order that applies to me in this case I am entitled to a hearing, substantive and procedural First Amendment Free Press concerns compel such a result. And if such an Order issues, it will be met with a visit to the ACLU as noted by Yours Truly. I will be filing an SJC Rule 1.19 Notice and checking the docket shortly. I have seen Massachusetts Courts issue gag orders before that Harvard's Citizen Media Blog held unconstitutional, Orders that the ACLU and Proskauer, Rose pursued all the way to the full SJC panel before Denner and his erstwhile partner Kevin Barron settled a malpractice case.

I don't plan on staying in State Court here, I plan on going straight to Federal Court because I will not stand for this sort of nonsense. There are no issues of National Security going on here and the child involved is 18 years of age. I can probably obtain a waiver from her anyway because as Attorney Jeffrey Denner noted, Adam Klein has been at best a sperm donor anyway. As far as I know, the only thing this Court may prevent me from publishing are the details of compensation for Columbia faculty felon and eMusic CEO Adam Klein. And Klein -- much as I'm certain he hates my publication and characterization of his criminal activities -- has no Cause of Action against me and if he raises one it will only heighten awareness of the issue in general.

Be that as it may, until I find law to the contrary I will assume that I am not entitled to that information and may not publish it, which is a crazy quirk of Massachusetts law as many States never impound such information. But if that is the law here in Massachusetts, then that is the Law and I will follow it because that's what I do. Follow the Law, unlike Adam Klein, ahem.

Courts have always had secret files for the prominent, and to some extent these protections have been eroded, even in paternity actions, which this case... is not. See generally Hartford Courant and Connecticut Law Tribune cases at the First Amendment Center. Note further that paternity is not even contested herein. Therefore, I would ask that the Court fully address the matter of impoundment de novo, because there is no undue embarrassment or harassment to befall Adam Klein if I publish his financial statements.

The embarrassment he has occasioned comes from the fact that he is a criminal, not from the fact that he managed to eek out a substantial corporate career notwithstanding. See George W. Prescott Pub. While in Prescott the Commissioner as public official has diminished privacy expectations, so too does the CEO of a very large ($70M revenue in 2009) international corporation who is a college professor with the ability to shape young minds. This is particularly true given the thorns in his past, everyone knows that convicted felons enjoy less privileges than the rest of us law-abiding citizens.

Further please note that husbands typically lose cases when they fail to provide financial information, but in this case the public documents in the Court of Appeals show a marked divergence from that history for some reason, see Wansong v. Wansong, 395 Mass 154 (1985).

The things I have seen going on in America's courtrooms throughout my life -- as a reporter and practicing attorney -- are patently unconstitutional, yet people without adequate resources are often forced to live with it. Well even here with shoestring budget, I fight these fights because the only life worth living, is the one in which you are free to live in the first place. Anything less is unacceptable.

Put simply I will not tolerate the Bench or these big shot lawyers threatening a little journalist like me with arrest for reporting public facts relating to anyone in any case. And you shouldn't stand for it either -- you should be interested in everything I have to say about Adam Klein that someone apparently missed in the vetting process. Everything I have published is a matter of public record That's what I do, and I will protect my right to do so using each and every legal recourse I can think of. I showed the courtesy of emailing counsel in this case already and asked if they wished to conduct interviews and they declined. Such is their prerogative. However that had nothing to do with my rights to cover this event in any way I deem appropriate, and I feel comfortable that my position will be vindicated in the Judicial process.

Don't you know the crime rate's going up up up up up... to live in this town, you must be tough tough tough tough tough..... especially at 15 Central Park West in $11M digs..... You gotta' shirk a lot of child support to afford that kinda' thing. Jeffrey Denner says Adam Klein was disrespectful to his daughter and a "biological father at best," I called him a sperm slinger, whatever. Jeffrey Denner said that Spencer Kagan had a malpractice case against him that Lee, Levine & Bowser hooked him up on so he could take the bench, I said the same damn thing.

Whatever, the World and Adam Klein's daughter all await production of a true and accurate income statement, they are entitled to it by law and many courts have ruled that other items such as stock options, and presumably bonuses may be attached for alimony and/or child support, see Wooters v. Wooters, Judge Gibson presiding. See also Braun v. Braun, 68 Mass. App. Ct. 84 (2007). I also question whether Monsieur should be paying the mother's attorney fees during all of this heavily-protracted litigation.

Uncle Ruckus says: "I ain't never met no nigga smart enough to use a damn personal computer.... not even a Macintosh!"

Dear Provost Steele:

Well I’ll be a monkey’s uncle. First You have to deal with David Epstein's incestuous relationship with his daughter, now this:

This is potentially a case of first impression because I can’t find any other case where an adjunct, associate or full professor withheld resume information about being a Convicted white-collar Felon. What Adam Klein did to Boumat, Ltd. is similar in timbre to what George Castro allegedly did to you, and if you didn't take it from Castro then you can't take it in Klein's background either, $320K vs. $5M same sleazeball intent.

Note: I doubt Jeffrey Denner or Linda Ouellette ever petitioned the Court for Klein to pay their attorney fees, a basic move in this sort of case. It serves as disincentive for the Defendant to engage in dilatory and dishonest tactics. I never did much Domestic practice because it's just a horrible thing all around, I did two amicable divorces and felt like I needed to puke weeks after each. But even I was surprised to learn that Denner and his posse never busted a grape on that. That right there is tantamount to legal malpractice in my books, and I sure do know about that, having forced Denner and Kevin Barron to pay out to Derrick Gillenwater in 2009 after they provided ineffective assistance of counsel.

Not only is Columbia University’s Adam Klein a convicted felon, but if the mother of his first child had been given the opportunity to argue her case, he may well have been returned to South Africa for imprisonment because he arguably committed Perjury during a series of lawsuits in Massachusetts. One such lawsuit was filed by Frank Kinzie of Quantum Associates, and it pertained to $90K of the attempted $320K heist that Klein attempted. If you would like me to pull the file I can do that for you and send you the pertinent documents excepting the confidential Settlement Agreement.

At the time he potentially committed Perjury in a Deposition with Mr. Kinzie, Adam Klein was subject to a Good Behavior Order as seen below, kind of like another one of my investigative subjects Gregory Floyd was under before he violated it…. And went to prison, where he sits today subject to a lawsuit NH Dist 2010-CV-181 that came about largely because of my efforts.
But I digress.

I raise these issues in the context of the quest for Journalistic Integrity that binds all of us together as professional journalists.

By now even the casual observer of this journal knows that I edited the Cincinnati Edition of
Ohio’s Call & Post, the only statewide black-owned newspaper before I reported with the Indianapolis Star. You should be familiar with these publications, as we both hail from the Buckeye State.

After law school I came to watch my first cousin blossom into the most recognizable black (or any other) sports journalist in the World. This is why I notified his alma mater of this issue. And his cousin was in turn one of the most recognizable black (or any other) anchors in the World. In point of fact she moderated a U.S. Presidential debate.
While they pursued more traditional paths in journalism, one thing that all of us have in common is that nobody could make a legitimate argument that any of us knowingly misrepresented anything on a job resume or in a story or journal entry.

Sadly, unless Columbia’s policy allows for Felonious faculty members, it does not appear that the same cannot be said for Columbia adjunct faculty member and eMusic CEO Adam Klein.[1] If he lied on his resume or application the simple fact is that he could be fired and the termination upheld even if he was fired for a different untenable reason and after-acquired evidence uncovered the falsification. Jordan v. Johnson Controls, 881 S.W.2d 363 (1994), Redden v. Wal-Mart Stores, 832 F. Supp. 1262 (1993)(black employee had theft by conversion conviction, ahem). In Colorado v. Saga Communs., 11 F. Supp. 2d 1292 (1998) (omitted and concealed a place of employment 10 years prior) provide the relevant analysis for us:

However, the Colorado Supreme Court, relying extensively on Gassman I, has addressed whether resume fraud acts as a complete bar to breach of employment contract claims:

[We] hold that after-acquired evidence of resume fraud may provide an employer with a complete defense to such claims.
To assert the defense of after-acquired evidence of resume fraud, an employer must prove that the employee's fraud was material and that a reasonable, objective employer would not have hired the employee if it had discovered the misrepresentation at the outset. The following factors are relevant to that determination.

First, would a reasonable employer have regarded the misstated or omitted fact as important? The nature of the misrepresentation and the extent to which it relates to qualifications for the job may bear on this issue.

Information about the employer's past conduct or policies may also bear upon this issue by focusing on what the employer regarded as important in a non-adversarial context. The second factor is whether the employee concealed or misrepresented the fact or facts with the intent of creating a false impression in the mind of the employer, citing Crawford Rehabilitation Services, Inc. v. As noted in one of the prior journal entries, I have had very close association with associate professor staff at Columbia and personal friends who have graduated from Columbia over the years, this will happen when you go to prep school. And again, each and every one of them is a stand-up individual as are their friends whom I have met in NYC and throughout the Country. As to the Professor, had there had been a pregnancy and child born I would have stood by whatever agreement we made, unlike Adam Klein.
Regardless of Adam Klein’s familial issues, it is clear that Senior Staff owes the International Academic World an explanation on this for several reasons:
First, every job application asks the Golden Question, “Have you ever been convicted of a Felony?” Without making too complex a syllogism here, let’s just say that whomever did the vetting didn’t care or Adam Klein lied. Either way an explanation is in order.
Second, this is a newsworthy event because it almost never happens. We’re used to seeing community college cocaine-smuggling falsifiers like David Silbergeld get the hook, or Harvard’s monkey-man Robert Fogel catch a reprimand from the U.S. Department of Health and Human Services after his misdeeds. It takes a while to prove data falsification. The same goes for Harvard’s Marc Hauser or MIT’s Luk Van Parijs, who was fired for data-doody as well.
Living a material lie and using that lie to gain access to the University before you commit further misdeeds cannot be tolerated either, and some learned Judges believe the gross falsification is an absolute bar to employment in the legal context.

The Disciplinary Board favored a three-year suspension. This Court is prepared to accept the latter sanction. I dissent on the grounds that the only suitable course of action is to issue a rule to show cause why he should not be disbarred.

The central focus of our attention should be on the issue of itself. This is not a case where an attorney was admitted properly and subsequently engaged in unprofessional [***4] conduct. Rather, the conduct runs to the question of whether he was eligible for admission in the first place. As I have indicated in my accompanying dissent in Office of [**266] Disciplinary Counsel v. Deborah Griffin, 637 A.2D 266, the Commonwealth has a reasonable right to reconsider that admission itself……..Failure to disclose falsification should be treated as fraud on the Court: it destroys all subsequent proceedings.

I’m quite certain that a lot of people in the Office of the Provost are mulling this one over as you should. As you must. This is odd given that Klein pursued her in the first instance by leaving a note on her car approximately 8 months before his daughter was conceived. He had been watching her take laps in the pool. The sexist Massachusetts Court of Appeals in issuing a not-for-record Opinion on the contractual agreement that Klein stopped paying 6 years in wrote that they had “a rather brief relationship,” implication being obvious. We all know Bill Christy, he's the guy who wrote "Try Gregory Floyd for Murder" to which I actively contributed, as one can see in this post. He's also the one who publicly said "I would have shot Bruce McKay as well," as noted in this post. He also argued that Floyd was in violation of 18 U.S.C. 922(g)(1), now he says he isn't. And we know that he calls blacks he doesn't like "Niggers" and incessantly follows me around, and has been posting most of my SSN number that he found on an obscure document that I accidentally posted 3 years ago because he can't stand the fact that I exposed his Janus-faced nature.

Well yesterday I get wind of the fact that he lied and told Scribd.com that he was the sole author of the material and that I was in DCMA copyright violation. Scribd.com thus removed "Try Gregory Floyd for Murder" and my entire account, on a first strike. Not knowing what the heck happened, I posted it back up in another of my Scribd.com accounts, then once Scribd.com told me what happened I apologized and sent them the proof that I had editorial and content input and they initially told me I should write a counter-affidavit, which I said I would do.

As all of my public documents, with thousands and thousands of reads on them were on Scribd.com, I wrote them back when they initially told me I could write a counter-affidavit. They were quite rude and Mr. Bently lied, telling me there was a "zero tolerance" policy on Copyright, but that's not true, read their own website here and here:

I'll be down at the ACLU tomorrow, the same ACLU who wrote the Mass SJC briefs for Derrick Gillenwater after I sent him over there as Boston Bob.

Moral of the story: Always keep your emails, never trust Bill Christy -- he's a slippery, slimy sort of LE, kind of like what the folks at MASSCOPS called Marty Dunn: A slime bag.

I got a report back that Citi Bank refused to cash Derrick Gillenwater's settlement check for his legal malpractice case against prominent Boston Attorney Jeffrey Denner. As I understand it, he had tried last week, they told him his ID was expired and they would cash it when he got a replacement. He got a replacement but now two different branches gave him the runaround and THREATENED TO ARREST HIM!!!

This strikes me as a wrongful dishonor situation so I'll publish the names of those involved for public awareness.
UPDATE: Washington Street Branch manager is Carlo Caramanna and the District Manager is Tim Sullivan.
UPDATE: It is a wrongful dishonor per Your Style v. Mid Town Bank of Chicago, 150 Ill. App. 3d 421, 427-28, 501 N.E.2d 805 (1986) as noted in this Indiana government website and in this Bankers Online article, "Cashing Checks for non-customers."

Meanwhile a quick search on racial discrimination yields this interesting lawsuit against Citibank by none other than Barack H. Obama, alleging that the bank was disparately treating minorities in lending.

Apparently they never learn, so they'll have to be taught again.

Or did Jeffrey Denner issue a bogus check to buy time or get his ass off the hot seat because he knew that a certain Civil Rights organization is waiting in the wings to help Mr. Gillenwater? Only time will tell.

Defendant Barron is still clubbing a defenseless seal and former client named Derrick Gillenwater:

I am sending a copy of this post on March 17, 2009 to Defendant Kevin L. Barron and his attorney Michael Cunningham, as I noted that Kevin L. Barron, charged with heroin possession and distribution in Norfolk 2008-350 and the lone remaining Defendant in the valid legal malpractice case of Gillenwater v. Denner et al., Suffolk 05-5469, has in my opinion deliberately and intentionally lied to the Court in violation of Rule 3.3 Candor toward the Tribunal. How did he do that? by getting a continuance on Summary Judgement for settlement purposes, then refusing to make a settlement counter-offer.

FACT: On March 10, 2009 Barron, by and through Attorney Michael Cunningham wrote:

"1. The defendants respectfully assert that there is good cause to allow this motion to enlarge the tracking order deadlines. See Superior Court Standing Order No. 1-88(D)(1)(amendments to tracking orders will be granted for “good cause shown”). As set forth above, parties are engaged in ongoing attempts to resolve this case prior to the service of defendants’ motions for summary judgment. "

FACT: But it is now March 17 and no settlement offer. This is yet another in a long line of abuses suffered by Plaintiff Gillenwater as the Court has continually treated this young black man as legal pariah, all because he has the stones to sue his high-powered, wealthy white attorneys. In my opinion, it is not conduct becoming of a licensed attorney(s) and it needs to be reviewed in conjunction with his adjudicated "Ineffective Assistance of Counsel," by Judge Diane Moriarty as noted in my very first post.

Note that it was yet another "emergency motion" that was rewarded with an "emergency ORDER" but that the Court STILL HAS NOT MOVED on Plaintiff Gillenwater's goddamn "emergency motion" to have his basic First Amendment and Fundamental Rights restored to even file pleadings!

There are a set of attorneys reviewing this matter, and when they spring into action I wish them all of the luck in the World to get this thing straightened out as I prepare to pummel these guys with opt-in emails, demonstrations at CLE seminars, law school fliers and whatever else it takes to expose this legally and morally corrupt activity.

Remember, Derrick Gillenwater still does not even know the name of the insurance carrier, 6 months after asking, and the Court knows all about it and does not care, just as the Court has now failed to address the (admittedly vague) ORDER from the Court of Appeals to take further action on Plaintiff's request to file basic pleadings -- which was taken from him even though there has been no finding that he filed anything that was frivolous. Somehow I feel that there is at least one bag man involved in this.

Well Derrick Gillenwater still doesn't know who the insurance carrier is -- which is totally illegal since he has probably asked about a dozen times, with the Court being fully aware of it. What he does know is that the insurance company can't seem to get him a check; he was promised on Friday, then some complications arose and he was promised "Monday."

It is now Monday, and the law students told me Mr. Gillenwater is just a bit upset over all of this. I completely understand his frustration.

What I don't understand is how Kevin Barron thinks he is going to fight this case, even though if anyone had an argument out of it it was Denner, because Denner was mostly vicariously liable; Barron is the one who did all of the "work." But I suppose if the Court continues to gag Mr. Gillenwater and stuff him in a broom closet Barron has a fighting chance. But something tells me Counselor Barron is in for a Big Surprise, one almost as big -- if not bigger -- than his ongoing heroin problems.

Maybe THAT's why he's not thinking clearly: If he's getting high on his own supply -- you know, provided that he "possessed" such a supply within the meaning of the Law -- that would certainly explain things.

It's still 1984: That's why Derrick Gillenwater cannot discover the name of Defendants Denner and Barron's insurance carrier.

Ever since October, 2008 Derrick Gillenwater has sought the identity of the insurance carrier(s) for legal malpractice Defendants Jeffrey Denner and Kevin Barron, and ever since October, 2008 the Defendants have successfully avoided providing this legally-required information. The Court has of course entirely silenced Mr. Gillenwater, so he can't blog about this case, and he can't even file any court documents -- even though there has never been any finding that he filed one single frivolous pleading.

The problem with not knowing the identity of the insurance company is that Mr. Gillenwater's rights have been violated (yet again) such that he can't proceed on a 93A Bad Faith claim for the insurance company not to pay on Defendant Barron's case. This issue was a point of inquiry in the Harvard Law School's Citizen Media Law Blog. Note that the Court identified the issue in its own ORDER while steadfastly ignoring Plaintiff Gillenwater's request. Now I hear that Mr. Gillenwater is supposed to settle his case with Attorney Denner on Monday, so the identity of the insurance company may finally be known because it may be on the check.

All of this made me wonder if it will be CNA Financial Corp., General Electric Co.'s Employers Reinsurance Corp., Hartford Financial Services Group Inc., American Financial Group Inc. or Arch Capital Group Inc, all of whom have been subpoenaed by former NY AG Eliot Spitzer for failing to diligently cover claims.

This case has shown us what is so very wrong about America's legal system in so many eye opening ways even I can't believe it, and I've been involved in law now for 3 solid decades. Derrick Gillenwater's music video hints at some of it, and as I understand it he is entitled to tell his life story, so long as he leaves out anything about this action. I'm sure by his conduct to this point (he refused to even discuss the amount of his upcoming settlement with Denner) that he will honor the terms of the agreement. Anyway, I look forward to hearing all about it -- especially the part about heroin-indicted Defense Lawyer Kevin L. Barron -- who apparently did not have his own insurance carrier. But again, how would we really know, since the Court doesn't care enough to order production of that information, ignoring Plaintiff's Motion to Compel and forbidding him to file any pleadings whatsoever.

We all know about Kevin Barron's problems of Ineffective Assistance of Counsel as ORDERED (and not appealed) from Judge Diane Moriarty. And thanks to me, we all know about his upcoming hearing on April 2, 2009 on his heroin possession and trafficking/distribution charges, Norfolk 2008-350. But what will happen? Well it's anybody's guess, really.

Here is what happened in Syracuse NY on a similar case last week.

Syracuse, NY -- A Syracuse man who smuggled drugs into jail, resulting in his brother's nearly fatal overdose, was sentenced today to serve two to four years in state prison.

County Judge Anthony Aloi said Marc Chetney, 32, of Bellevue Avenue, was lucky he wasn't facing a homicide charge. The judge also said Chetney had not learned anything from a prior prison sentence on a drug charge and was likely to be right back in trouble in the future.

Chetney pleaded guilty last month to first-degree promoting prison contraband, admitting he smuggled heroin to his 30-year old brother, Sean, in the Justice Center jail during a visit Nov. 24. The younger Chetney ended up hospitalized in critical condition after being found unconscious in his cell the following morning.

"You and he are probably equally stupid," Aloi said.

I say Kevin Barron is also pretty stupid for letting Derrick Gillenwater's case get so out of hand, but then again maybe he just overlooked it, seeing as he's got other issues on his plate, like whether the Court will give him designer leg chains to match his suit when he defends this legal malpractice case at trial.

Enough already. It's time Jeffrey Denner and Kevin Barron had better start saying their prayers, and stop acting like bad white people.

I'm going to say this one last time fellas: Quit fucking around with Derrick Gillenwater. The shit you got away with on this kid thus far is absolutely insane and you fucking know it. Well my congratulations may have been a bit premature. The law students tell me that Derrick Gillenwater is furious that he was promised a sum certain, and that he agreed to it orally with a set of stipulations he drafted and emailed to them, which makes a contract.

Now from what I hear they say they aren't certain when it will happen, and that now the insurance carrier wants the negotiated sum against Denner to be applicable to both Defendants.

Derrick Gillenwater should tell them to kiss his ass, along with the magic legal words, "I agreed to a Settlement.... not to an illusory promise."

Meanwhile, who is the insurance carrier? I'm about to ream them a good one, and Mr. Gillenwater has been lawfully seeking that information to which he is entitled, for months now, a record of that being so noted in Court.

And speaking of Court, let's see what happens on April 2, 2009 with respect to Defendant Kevin Barron's criminal charges for heroin possession and/or trafficking. What a coincidence, the very same crime that Derrick Gillenwater was chaged with and innocent of, is the very same crime that his lawyer is accused of, and he apparently really had the goods on him, as opposed to having the goods planted in the evidence room, which is what happened to Derrick Gillenwater. Good thing Barron is not representing himself, that might lead to another claim of ineffective assistance of counsel, like the (unappealed) ORDER handed down from Judge Diane Moriarty. The order is tiled in this post that includes Mr. Gillenwater's first Motion for Summary Judgment -- that the Court told him he is NOT ALLOWED TO FILE for some reason. It's really an unbelievable case. I just wonder how many other Derrick Gillenwaters are out there languishing without legal help, or the help of anonymous bloggers. Right here in America.

I emailed Kevin Barron's attorney and told him point blank: Some battles are not worth fighting, Sir.

There's Attorney Barron now, and as an infant, in the doctor's hands. In this post I asked what his problem is in taking care of the ineffective assistance of counsel he afforded to Derrick Gillenwater. But now I wonder how this case ever turned up for Attorney Barron.

Kevin L. Barron was being searched by corrections officers at about 5 p.m. yesterday before entering MCI-Cedar Junction when the officers found "small packets of a powdery substance" that turned out to be heroin, said Norfolk district attorney's spokesman David Traub.

Barron pleaded not guilty today at his arraignment in Wrentham District Court to charges of delivering drugs to a prisoner, possession of a Class A substance, and possession with intent to distribute a Class A substance.....

......Judge Warren Powers also ordered Barron to stay away from the state prisons. But Weinstein said he would seek to have that order modified "because he's a good lawyer and how else can he effectively represent his clients if he can't meet with them?"

We don't care that the Single Justice didn't address your First Amendment Rights. You are stuck with it unless you appeal to the Supreme Judicial Court. See G. L. c. 231, § 114.

But that's not necessarily an accurate assessment of the law goddammit:

The defendant in Duong presented the issue of a stay pending appeal to three separate judges before he got the full bench of the Supreme Judicial Court to consider the issue. He could have taken up more judicial resources if he had wanted to take the time, since the ordinary course of review of a decision by a single justice of the Appeals Court is to a full panel of that court, with the opportunity to seek further review in the Supreme Judicial Court.

Kevin Barron is a rapacious shark who will take a bite out of the ass of the client who already fed him before falling victim to his ineffective assistance of counsel, as held by Judge Diane Moriarty. It's a Good Thing that the law students tell me that Derrick Gillenwater may in fact be close to settlement in his legal malpractice case with Attorney Barron's co-Defendant, prominent Boston Attorney Jeffrey Denner. If so, I applaud that development and wonder what Kevin Barron's excuse is -- because he's really much more culpable in all of this than Denner. Barron was the lead attorney-in-fact, not Denner. In my opinion, it is his fault that Derrick Gillenwater went to prison without Just Cause.

In fact, Denner was only liable by dint of vicarious liability; I'm not certain that he ever filed anything. It is my further understanding -- and this would be triple quadruple super-secret swear on your grandmother's grave hearsay -- that Denner had a bunch of red tape to get through in order to resolve this case, and that careful reflection on the ultimate denial of Plaintiff Gillenwater's Civil Rights led him to whatever agreement he has reached, or may be reaching, with his former client.

As to Attorney Barron, I hope Mr. Gillenwater takes him to trial and gives him the most embarrassing moment of his adult and professional life. Boycott Kevin L. Barron.

There's Plaintiff Gillenwater at sidebar facing Judge Giles and opposing counsel. Not a pretty sight, is it?

Okay, so first she acknowledges that Plaintiff Gillenwater, a black man without much money (having wasted all of it on Jeffrey Denner) is not allowed to file any memoranda whatsoever in his valid legal malpractice action against wealthy and very white high-powered Boston Attorney Jeffrey Denner.

She then for some reason wants to know why Plaintiff Gillenwater might actually want a copy of the transcript from her court acknowledging this patent First Amendment and Fundamental Civil Rights violation. "Why do you need that," she asks. Twice, as if she needed to make herself look even more stupid, hateful and bigoted. To file a Motion for you to recuse your crooked, bigoted self, my dear.

But not to rest on her bigoted laurels, she then continues to ignore -- for an entire month now -- this Order from the Single Justice that there was to be further action on Plaintiff's Emergency and other Motions to restore his right to file a Motion for Summary Judgement and Motion to Compel regarding the Jeffrey Denner/Richard D. Abbott Oscar Atehortua (and presumably other) fiascos. See BD 2001-045.

Is this the first time that Jeffrey Denner screwed Derrick Gillenwater?

I am learning more from the law students, but it appears that Mr. Gillenwater was forced to report to a PO for an ancient case, under a Federal order --- when the law said he did not have to do so. Apparently his lawyer Jeffrey Denner let it all happen, and Mr. Gillenwater had to go to the law library himself to prove to the Judge that he was right, then they let him go. After he served time and had his Civil Rights violated, of course.

Can Derrick Gillenwater's daughter go through the same Federal Courthouse doors as Jeffrey Denner to get a public service award & Rights for Derrick?

Well, I have it on Good Faith through the Gillenwater Grapevine that on Tuesday, March 3 2009 Derrick Gillenwater's daughter will walk through the doors of the Joseph Moakley U.S. Courthouse and receive an award for her years of public service. It is the annual meeting for The Medical Foundation, with an awards ceremony to exactly two young women and a keynote speech to be delivered by Dr. David L. Katz (Yale School of Public Health) who will discuss prevention -- putting health back into health care reform. Perhaps while Ms. Gillenwater is there she can inquire if her father will ever receive any respect from any courthouse. We know he won't get any from that proud peacock Jeffrey Denner, seen strutting through the foyer a few years ago before he got each and every First Amendment and Fundamental Right taken away from her father in his valid legal malpractice claim against Denner and Kevin Barron. Read the Decisions that Harvard Law School and I contend are Unconstitutional right here.

Of course, as noted in the last post about the Touch FM 106.1 3,100 mile Walk for Power, Derrick Gillenwater is hardly the first intelligent black man in Boston to get his First Amendment or related liberties stripped away. Ask Councilman Chuck Turner and Lovell Dyett for starters. Could be time for some more fliers.

Note: Postponed due to snow storm. In two short days, folks will be passing hundreds of fliers at the Touch FM 106.1 Walk for Power rally.

The Walk for Power, led by Charles Clemons, is meant to make plain black media owners’ plight and the African American community’s need to control and manage vehicles of information and education....

The station is already starting to track his autobiographic song "Da Mack is what they call me," (myspace.com/buckshotdamack) about power, corruption and lies and how prominent Boston Attorney Jeffrey Denner and Kevin Barron got Mr. Gillenwater's First Amendment Rights to blog about his legal malpractice case against them taken away. He went to jail for no good reason, ordered Judge Diane Moriarty. Then they also got some morally vacant judges to strip away his rights to even file legal pleadings in the case. It sounds outlandish but it's true.

Defendant Jeffrey Denner, a white "Civil Rights" lawyer who has made tons of money from black folks and other minorities over the years, is the benefactor of these classist and racist court rulings that are all held on this blog.

Denner also claimed to have knowledge of Diane Wilkerson's pending investigation before it went public, and he used it against Mr. Gillenwater to threaten him. Jeffrey Denner also got this blog taken down until I forced the issue and Blogger restored it. The folks at Harvard Law School's "Citizen Media Project" have this to say (click on last link).

Boston is a racist town. Remember how the authorities treated allblackmen in the Carol Stuart murder "investigation?"

PS: No disrespect to local radio legend Lovell Dyett, but it just occurred to me as kind of an afterthought that his situation is directly related. Another black man of above-average intelligence, trying to assert himself in a manner that may challenge Boston's largely white power structure is effectively silenced after he and a younger white co-worker were temporarily released and called back. On return to work, his white counterpart was called back in a nice cherry time slot but he got the proverbial graveyard shift and at -- get this -- one sixth the airtime. Read the February 10 Boston Globe story and the February 26 Boston Banner story (sorry, that story I cannot find online. I used the February 5 story instead).
